End-User License Agreement (EULA)

1. TERMS AND DEFINITIONS

• Swyfttrade: Refers to the registered trademark and software ("Swyfttrade Platform"), developed and distributed by Swyfttrade Ltd and/or its affiliated entities.
• Platform: The Swyfttrade software, which is an automated trading system allowing users to reproduce trading signals generated by third parties ("Signal Providers") into their broker trading accounts ("Trading Accounts") automatically.
• Affiliate Entity: Any company, corporation, or physical person that directly or indirectly controls or significantly influences the operations of Swyfttrade.
• Financial Institution: Any third-party entity offering users financial, brokerage, or trading services.
• User Account: The account you register with to access and use the Platform.
• Login / Password: Credentials you use to securely access your User Account.
• Effective Date: The date you accept this Agreement by clicking "Accept" or by using the Platform.

2. LICENSE GRANT AND RESTRICTIONS

2.1 License

Swyfttrade grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Platform on your electronic devices solely for lawful purposes and in accordance with this Agreement.

2.2

Swyfttrade may modify, discontinue, or suspend any part of the Platform at any time, without notice.

2.3

You may not sell, rent, sublicense, distribute, export, or assign the Platform to any third party.

2.4

You may not modify, reverse engineer, decompile, or disassemble the Platform or any part of it. Unauthorized access or tampering with the Platform's databases, APIs, or network protocols is strictly prohibited.

2.5

The Platform may include or interact with third-party software, which may be subject to separate license terms. You agree to comply with such third-party terms.

2.6

All intellectual property rights in the Platform and related materials remain the exclusive property of Swyfttrade and its licensors. This Agreement does not grant you any ownership rights.

2.7

You agree to use the Platform in compliance with all applicable laws and regulations. You represent that you are not subject to any sanctions or restrictions under U.S. or international law.

2.8

Swyfttrade does not guarantee that the Platform will produce profitable trading results. Any trading decision you make is solely at your own risk.

2.9

Swyfttrade reserves the right to modify this Agreement at any time. Updated versions will be posted at https://www.swyfttrade.com/legal. Continued use of the Platform constitutes acceptance of the revised terms.

3. PRIVACY AND DATA PROTECTION

3.1

Swyfttrade may collect personal and non-personal information about you, such as your name, email address, and technical device data, for purposes of account creation, analytics, customer support, and platform improvement.

3.2

Data processing will comply with Swyfttrade's Privacy Policy, available at https://www.swyfttrade.com/privacy.

3.3

You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. Notify Swyfttrade immediately of any unauthorized access or suspected breach.

3.4

By using the Platform, you consent to the processing and transfer of your data as described in this Agreement and the Privacy Policy.

4. DISCLAIMER OF WARRANTIES

4.1

The Platform is provided "as is", without warranties of any kind, whether express, implied, or statutory. Swyfttrade disclaims any warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Platform will be error-free, uninterrupted, or secure.

4.2

Swyfttrade does not control brokers or third-party data providers. It is not responsible for their performance, accuracy, or any issues arising from third-party integrations.

4.3

Swyfttrade is a technology provider only. It does not act as a broker, advisor, or financial intermediary and assumes no responsibility for trading outcomes or broker relationships.

5. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

• Swyfttrade shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits or data, resulting from use of or inability to use the Platform.
• Swyfttrade is not responsible for any losses resulting from delays, data transmission issues, broker failures, or software malfunctions.
• Your sole remedy for dissatisfaction with the Platform is to stop using it and uninstall it.

Some jurisdictions do not allow the exclusion of certain warranties or limitations, so some of these exclusions may not apply to you.

6. TERMINATION

6.1

This Agreement is effective until terminated.

6.2

You may terminate it at any time by uninstalling the Platform and deleting your account.

6.3

Swyfttrade may suspend or terminate this Agreement immediately if you breach its terms, engage in illegal or fraudulent activity, or misuse the Platform.

6.4

Upon termination, your license rights end, and you must destroy all copies of the software.

7. MISCELLANEOUS

7.1 Governing Law

This Agreement is governed by the laws of England and Wales (or specify your jurisdiction).

7.2 Jurisdiction

Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of London, United Kingdom (modifiable to your jurisdiction).

7.3 Severability

If any provision of this Agreement is held invalid, the remaining terms shall remain in full force and effect.

7.4 Entire Agreement

This Agreement constitutes the entire understanding between you and Swyfttrade regarding the Platform and supersedes all prior versions or communications.

7.5 Language

The English version of this Agreement shall prevail over any translations.
